In brief
Secondary legislation (SI 2012/1943, in force 31 October 2012) prescribing premises standards for local-authority-maintained schools in England, including pupil referral units. Reg 4 is the load-bearing facilities provision: reg 4(1) suitable toilet and washing facilities for the sole use of pupils; reg 4(2) separate toilet facilities for boys and girls aged 8 or over, except where the facility is in a room securable from the inside and intended for use by one pupil at a time; reg 4(3) disabled-facilities sharing exception; reg 4(4) suitable changing accommodation and showers for pupils aged 11 or over at the start of the school year who receive physical education. 'Suitable' is defined by reg 2(2): suitable for the pupils in respect of whom it is provided, having regard to their ages, numbers and sex and any special requirements they may have. The instrument also covers medical accommodation (reg 5), health, safety and welfare (reg 6), acoustics (reg 7), lighting (reg 8), water supplies (reg 9) and outdoor space (reg 10). Reg 3 inserts an application provision into the Education (School Premises) Regulations 1999 confining the 1999 Regulations to schools maintained in Wales — the 2012 Regulations are the substantive England standards, not an amending instrument.
