In brief
Department of Education (Northern Ireland) guidance on child protection and safeguarding for schools and other education settings in Northern Ireland, announced by DE Circular 2026/17 on 27 August 2026: the Northern Ireland counterpart to Keeping Children Safe in Education, which applies in England only. It is "statutory guidance issued by the Department of Education (DE) under Article 18(1)(c) of the Education and Libraries (Northern Ireland) Order 2003", the Board of Governors of a grant-aided school has a duty to have regard to it, and "this guidance reflects statutory duties, compliance is mandatory" (paragraph 1.3 of the guidance). It applies to schools of all kinds, independent schools, early years settings, education other than at school, and youth work settings (paragraph 1.4). It is a safeguarding framework: roles and responsibilities, governance, how to recognise, respond to, report, record and refer concerns, and workforce duties, with a Companion section on a whole-school approach and a safe school environment. It has no trans-specific content: its text does not contain the words "transgender", "gender identity", "gender reassignment" or "single-sex", and nothing about gender-questioning pupils or social transition. The nearest content is one item in the premises section, which lists "safeguarding considerations in the use of toilets, changing areas" among its premises requirements without saying what they are (Companion 2, paragraph 2.1), and a line on "promotion of equality, inclusion and respect" (Companion 1, paragraph 1.2).
Key provisions
- Para 1.3 — Status: statutory guidance, a duty to have regard : Per para 1.3, "This is statutory guidance issued by the Department of Education (DE) under Article 18(1)(c) of the Education and Libraries (Northern Ireland) Order 2003 and relates to the welfare and protection of pupils", and the Order places a duty on the Board of Governors of a grant-aided school to have regard to it when determining the measures to be taken at the school. "This guidance reflects statutory duties, compliance is mandatory. Where the guidance reflects best practice, settings are expected to have due regard and to be able to demonstrate and evidence their approach, particularly in the context of inspection." Per para 1 of the circular, Boards of Governors are required to have regard to the guidance when determining measures to safeguard and promote the welfare of pupils, and per para 2 it does not create new statutory safeguarding duties but consolidates existing requirements.
- Para 1.4 — Scope: every education setting in Northern Ireland : Per para 1.4, the guidance applies to statutory and non-statutory pre-school and early years settings; primary, post-primary and special schools; education other than at school (EOTAS), including commissioned alternative education providers; independent schools; Education Authority youth services and voluntary and community youth work services; and any other organisation commissioned or funded to provide education or educational support on behalf of DE, the Education Authority or other managing authorities. It also applies, where relevant, to young people aged 18 and over who remain in education and to adults at risk who come into contact with education settings. Settings must apply it together with the relevant safeguarding legislation, DE circulars, the Safeguarding Board for Northern Ireland procedures and Health and Social Care frameworks.
- Companion 2, para 2.1 — Safe school site and premises: the only reference to toilets and changing areas : Per Companion 2, para 2.1, "Schools must ensure that premises are secure, appropriately supervised and designed to reduce safeguarding risk", which includes controlled access and visitor management, regular documented risk assessments of buildings, grounds and any areas used by pupils, appropriate supervision including break and transition times, "safeguarding considerations in the use of toilets, changing areas, and less spaces within the setting" (as printed), and clear emergency procedures; arrangements must be proportionate, reviewed regularly and informed by identified risk. Per Companion 2, para 2.5, schools with boarding or residential provision must make "arrangements that respect pupils' privacy, dignity, and wellbeing in residential settings".
- Companion 1, paras 1.2 and 1.6 — Inclusive ethos and prejudice-based bullying : Per Companion 1, para 1.2, a safe setting is "underpinned by a positive, inclusive and respectful culture", and settings should ensure, among other things, "promotion of equality, inclusion and respect". Per Companion 1, para 1.6, Boards of Governors must ensure the school complies with the Addressing Bullying in Schools Act (Northern Ireland) 2016; schools must maintain and implement an addressing bullying policy, record all incidents of alleged bullying behaviour, identify and address patterns and trends, support pupils involved, and consult pupils and parents or carers when reviewing practice; "Bullying, including prejudice-based and online bullying, may constitute a safeguarding concern and must be responded to accordingly."
- Companion 1, para 1.5 and note 33 — Equality terms appear only as a footnote : Per Companion 1, para 1.5 (attendance and engagement), the guidance refers to "vulnerable groups at higher risk of disengagement", and note 33 says "This list is not exhaustive but can include children with SEND; children in need and/or on the child protection register; children looked after; other section 75 groups". Per Companion 1, para 1.8, schools must ensure safeguarding approaches are responsive to the needs of a listed set of groups, which includes children looked after, newcomer pupils, Traveller children, children with special educational needs or disabilities, and young carers, and does not list sexual orientation or gender identity.
When relevant
Relevant to a school or education setting in Northern Ireland asking what its safeguarding duties are and what status the Department of Education's guidance has (paragraphs 1.3 and 1.4), and to a multi-nation education body that needs each nation's counterpart to KCSIE-2026, which applies in England only. It has no trans-specific content: it does not address single-sex toilets or changing rooms, gender-questioning pupils or social transition. The only premises content is a risk-assessment prompt covering toilets and changing areas (Companion 2, paragraph 2.1), and the toolkit cannot draw any answer on who may use which facilities from it. Northern Ireland equality law is a separate framework that this record does not cover. Decision support, not legal advice.
