His voice is starting to deepen but remains inconsistent — he sometimes passes as male, sometimes does not. He has short hair and wears workwear. He is not post-operative and does not hold a Gender Recognition Certificate.Dex is out to his employer and his immediate team of six. His employer completed a basic HR process — updated his name on the system and informed the team. Responses have been mixed: some colleagues are supportive, some indifferent, one hostile. The site operates single-sex portacabin facilities with no neutral option. There is nowhere for Dex to change on site. Every morning, in all weathers, he changes in his van in the car park.His right to use male facilities does not depend on how male he looks. It does not depend on whether his voice passes. It does not depend on whether his binder is visible under his hi-vis when he crouches to lay a course. It depends on the fact that he is a man, that his employer knows he is a man, and that the Equality Act 2010 protects him from less favourable treatment on the grounds of gender reassignment.
